These Terms & Conditions (“Terms”) govern your access to and use of the Cacha website, mobile application, Cacha Labs and related products, features and services (collectively, the “Services”).

By accessing or using Cacha, creating a Cacha account, registering for Cacha Labs or otherwise using our Services, you agree to these Terms. If you do not agree to these Terms, you should not use the Services.

Cacha provides technology that helps users store, organise, access and manage information relating to gift cards. Cacha does not issue the third-party gift cards stored within the Services and is not a bank, financial institution or gift card issuer.

Cacha is initially intended for users in Australia and New Zealand. Your use of the Services may also be subject to applicable local laws and regulations.

1. Eligibility and Accounts

You must be legally capable of agreeing to these Terms or have the involvement and permission of a parent or legal guardian where required by applicable law.

Some Cacha features may require you to create an account.

When creating and using an account, you agree to provide accurate information and keep your account information reasonably up to date.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity occurring through your account.

You should notify Cacha promptly if you believe your account has been accessed or used without your permission.

You must not attempt to access another person's Cacha account without their permission.

2. What Cacha Provides

Cacha is designed to help users digitally store, organise and access information relating to their gift cards.

Depending on the features available in the version of Cacha you are using, these Services may include functionality that allows you to:

  • Add gift cards manually or by scanning supported information.

  • Store gift card numbers and barcode information.

  • Display supported gift card barcodes for use at checkout.

  • Store expiry dates and other gift card information.

  • Receive reminders or notifications relating to gift cards.

  • Add notes, names or images to stored gift cards.

  • Manage and organise gift cards within your Cacha wallet.

  • Participate in Cacha Labs, beta testing and early-access programs.

Features may be added, changed, removed or improved as Cacha develops.

3. Gift Cards

Cacha is a digital wallet and management service. Unless expressly stated otherwise, Cacha does not issue, sell, activate, redeem, fund or guarantee gift cards stored within the Services.

Gift cards are issued and controlled by the relevant retailer, brand or gift card provider.

The issuer's own terms and conditions govern matters including:

  • Gift card balances.

  • Activation.

  • Expiry.

  • Redemption.

  • Participating stores.

  • Online or in-store acceptance.

  • Refunds.

  • Replacement of lost or stolen cards.

  • Restrictions on use.

  • Other conditions imposed by the gift card issuer.

You are responsible for checking the applicable issuer's terms before relying on information stored or displayed through Cacha.

4. Accuracy of Gift Card Information

Cacha aims to provide tools that make managing gift cards easier, but we cannot guarantee that information associated with a third-party gift card is complete, accurate or current.

You are responsible for checking important gift card information with the relevant issuer.

Information you manually enter into Cacha is dependent on the information you provide.

Scanning, barcode recognition or other automated features may occasionally produce incorrect or incomplete results. You should check scanned information before relying on it.

5. Gift Card Balances

Where Cacha displays, stores or allows you to enter a gift card balance, that balance should not necessarily be treated as an authoritative statement of the funds available on the gift card.

Unless Cacha has a verified integration with the relevant gift card issuer, balance information may be based on information entered by the user or other available information.

The gift card issuer's records determine the actual balance available for redemption.

6. Barcodes and Card Numbers

Cacha may allow users to store and display gift card numbers, barcodes, QR codes or similar information.

Displaying a barcode through Cacha does not guarantee that a retailer will accept the barcode or allow the gift card to be redeemed digitally.

Retailers may have their own requirements regarding digital gift cards, screenshots, physical cards, identification or other methods of redemption.

You remain responsible for complying with the relevant retailer's requirements.

7. Expiry Dates and Notifications

Cacha may provide tools designed to help users track gift card expiry dates and may provide expiry reminders or notifications.

These features are provided as a convenience and should not be relied upon as the sole method of monitoring a gift card's expiry.

Notifications may be delayed, unavailable or prevented by factors outside Cacha's reasonable control, including device settings, internet connectivity, notification permissions, operating-system restrictions or incorrect information entered by the user.

You remain responsible for checking the official expiry conditions of your gift cards with the relevant issuer.

8. Ownership and Authorised Use of Gift Cards

You may only add, store, access or use gift card information that you own or are otherwise authorised to possess and use.

You must not use Cacha to store, obtain, distribute or attempt to redeem stolen, fraudulently obtained or otherwise unauthorised gift cards.

Cacha may take reasonable action where we believe the Services are being used for fraudulent, illegal or abusive activity.

9. Acceptable Use

You agree not to use Cacha:

  • For unlawful, fraudulent or deceptive purposes.

  • To access or attempt to access another user's account without permission.

  • To store or use gift cards you are not authorised to use.

  • To interfere with the operation or security of Cacha.

  • To introduce malicious software or harmful code.

  • To probe, scan or test Cacha systems for vulnerabilities without authorisation.

  • To circumvent security, authentication or access controls.

  • To reverse engineer or attempt to extract source code except where expressly permitted by law.

  • To impersonate another person or misrepresent your identity.

  • To abuse, disrupt or misuse Cacha, Cacha Labs or related services.

We may investigate suspected misuse and take appropriate action where reasonably necessary.

10. Cacha Labs and Beta Features

Cacha Labs may provide selected users with access to beta, experimental, preview or early-access features.

Cacha Labs features may:

  • Be incomplete or experimental.

  • Contain bugs or errors.

  • Operate differently from final public features.

  • Be changed or removed without notice.

  • Experience interruptions or data loss.

  • Not be suitable for critical or time-sensitive use.

Participation in Cacha Labs is voluntary.

We may ask participants to provide feedback about features and their experience using Cacha.

Additional conditions may apply to particular beta programs and will be communicated where appropriate.

11. Feedback

If you provide suggestions, ideas, comments or other feedback about Cacha, you give us permission to use that feedback to develop, improve and operate Cacha without an obligation to compensate you.

This does not transfer ownership of your personal information or gift cards to Cacha.

12. Privacy

Your privacy is important to us.

Our collection, use, storage and handling of personal information is described in the Cacha Privacy Policy, which should be read together with these Terms.

By using the Services, you acknowledge that information will be handled in accordance with our Privacy Policy and applicable privacy requirements.

13. Security

Cacha takes reasonable steps to protect its systems and user information.

However, no internet-connected service, application or electronic storage system can be guaranteed to be completely secure.

You are responsible for taking reasonable precautions to protect your account, device, login credentials and gift card information.

Do not intentionally share sensitive gift card information, including card numbers or PINs, with people you do not trust.

If you believe your Cacha account has been compromised, contact us promptly.

14. Third-Party Retailers and Services

Cacha may display information relating to retailers, brands, gift card providers or other third parties.

Unless expressly stated otherwise, this does not mean that Cacha is affiliated with, sponsored by, endorsed by or partnered with those third parties.

Retailer names, trademarks and logos remain the property of their respective owners.

Cacha may also rely on third-party technology and service providers to operate portions of the Services.

Your interactions directly with third-party retailers or services may be governed by their own terms, conditions and privacy policies.

15. Intellectual Property

Cacha and its associated branding, software, designs, graphics, interfaces, content, trademarks and other intellectual property are owned by or licensed to Cacha, except for third-party material.

You may use the Services for their intended personal purposes.

You may not copy, reproduce, modify, distribute, sell, license or commercially exploit Cacha intellectual property without permission, except where permitted by law.

Nothing in these Terms transfers ownership of Cacha's intellectual property to you.

16. Availability and Changes to the Services

We aim to keep Cacha available and reliable, but we do not guarantee uninterrupted or error-free access.

The Services may occasionally be unavailable because of maintenance, upgrades, technical problems, third-party outages or circumstances outside our reasonable control.

Cacha may modify, update, add, suspend or discontinue features as the product develops.

There reasonably practicable, we will endeavour to provide appropriate notice of significant changes that materially affect users.

17. Account Suspension and Termination

You may stop using Cacha at any time.

Where account-deletion functionality is available, you may request or initiate deletion of your Cacha account in accordance with our applicable processes.

Cacha may restrict, suspend or terminate access to an account where we reasonably believe:

  • These Terms have been seriously or repeatedly violated.

  • The account is being used for fraud, illegal activity or abuse.

  • The account creates a security risk.

  • Suspension or termination is required by law.

  • Action is reasonably necessary to protect Cacha, our users or third parties.

Where appropriate and legally required, we will provide reasonable notice or an opportunity to address the issue.

18. Deleting Your Account

Deleting your Cacha account may result in the deletion of gift card information and other information associated with your account.

You should ensure you retain any gift card information you require before deleting your account.

Deletion and retention of personal information are handled in accordance with the Cacha Privacy Policy and applicable law.

Some information may need to be retained where required or permitted for legal, security, fraud-prevention or legitimate operational purposes.

19. No Financial Advice or Financial Services

Cacha is a gift card management application.

Cacha is not a bank, financial institution or financial adviser, and the Services are not intended to provide financial, investment, legal or tax advice.

Storing information about a gift card within Cacha does not create a deposit, account balance or financial product held by Cacha.

20. Consumer Rights

Nothing in these Terms is intended to exclude, restrict or modify rights or remedies that cannot lawfully be excluded, restricted or modified.

Users in Australia may have rights under the Australian Consumer Law, and users in New Zealand may have rights under applicable New Zealand consumer protection laws.

Where a statutory guarantee, right or remedy applies and cannot lawfully be excluded, these Terms operate subject to that guarantee, right or remedy.

21. Disclaimers

To the extent permitted by law, Cacha does not guarantee that:

  • The Services will always be available or uninterrupted.

  • Every gift card will work with Cacha.

  • Every retailer will accept a barcode displayed through Cacha.

  • Gift card information supplied by third parties will always be accurate.

  • Expiry reminders will always be delivered.

  • User-entered information will be correct.

  • A lost, expired, cancelled or stolen gift card can be recovered through Cacha.

Cacha is a tool for managing gift card information and does not replace the official records or terms of the gift card issuer.

22. Limitation of Liability

To the extent permitted by applicable law, Cacha will not be responsible for losses caused solely by circumstances outside our reasonable control or by inaccurate information supplied by a user or third-party gift card issuer.

This may include losses arising from expired gift cards, incorrect balances, retailer refusal to accept a gift card, incorrect card details, missed notifications or unauthorised use where Cacha has complied with its applicable legal obligations.

However, nothing in these Terms excludes or limits liability, consumer guarantees, statutory rights or remedies where doing so would be unlawful.

23. Indemnity

To the extent permitted by law, you agree to be responsible for losses, costs or claims reasonably incurred by Cacha arising directly from your unlawful or fraudulent use of the Services or your serious breach of these Terms.

This section does not apply to the extent that the loss or claim was caused by Cacha's own unlawful conduct, negligence or breach of an applicable obligation.

24. Changes to These Terms

Cacha may update these Terms from time to time as our Services, technology, business or legal obligations change.

When these Terms are updated, we will change the “Last updated” date at the top of this page.

If we make significant changes that materially affect users, we may provide additional notice through the Cacha website, application, email or another appropriate method.

Your continued use of Cacha after updated Terms take effect may constitute acceptance of those Terms where permitted by applicable law.

25. Governing Law

These Terms are intended to operate in accordance with applicable laws in the markets where Cacha provides its Services.

For users in Australia, applicable Australian laws and mandatory consumer protections continue to apply.

For users in New Zealand, applicable New Zealand laws and mandatory consumer protections continue to apply.

Nothing in these Terms is intended to prevent a user from exercising rights available under applicable consumer or other laws that cannot legally be excluded.

26. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the extent necessary where legally possible.

The remaining provisions will continue to operate to the extent permitted by law.
